1. Acceptance of Terms
By downloading, installing, or using the Nom404 app or website ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
Nom404 is a mobile and web ordering platform that allows customers to scan QR codes at participating businesses (restaurants, cafes, food stalls) to browse menus, place orders, and submit payment. Nom404 acts as a technology intermediary between customers and businesses.
3. Account and Guest Use
- You may use the Service as a guest without creating an account.
- If you create an account, you are responsible for maintaining the confidentiality of your credentials.
- You must provide accurate information when creating an account.
- You must be at least 13 years old to use the Service.
4. Orders and Payments
- All orders are placed directly with the participating business, not with Nom404.
- Prices, availability, and menu items are set by each business and may change without notice.
- Payment is made via GCash, Maya, or cash as offered by the business. Nom404 does not process payments directly.
- Payment proof (screenshots) uploaded through the Service are shared with the business for verification purposes.
- Order cancellations and refunds are handled by the business according to their own policies.
5. User Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Submit false payment proof or fraudulent orders
- Interfere with or disrupt the Service's operation
- Attempt to access other users' accounts or data
- Post abusive, offensive, or fraudulent reviews
- Use automated systems or bots to interact with the Service
6. Reviews and Content
- You may submit reviews and ratings for businesses you have ordered from.
- Reviews must be honest and based on genuine experiences.
- Nom404 reserves the right to remove reviews that violate these Terms or are flagged as abusive.
- By submitting a review, you grant Nom404 a non-exclusive license to display it within the Service.
7. Intellectual Property
The Service, its design, logos, and content are the property of Nom404. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
8. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. Nom404 does not guarantee:
- The accuracy of menu items, prices, or business information
- The quality, safety, or legality of food prepared by businesses
- Uninterrupted or error-free operation of the Service
9. Limitation of Liability
Nom404 is not liable for:
- Food quality, preparation, allergens, or hygiene at participating businesses
- Payment disputes between customers and businesses
- Losses resulting from unauthorized access to your account
- Any indirect, incidental, or consequential damages arising from use of the Service
10. Termination
Nom404 may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason. You may stop using the Service and delete your account at any time.
11. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the Republic of the Philippines.
